On-Stream Music

I am fully aware that this is a "grey area" on Twitch, and a reasonably over asked question, but the broadcasting of copyrighted music has got me positively confused. While I understand that twitch operates within the safe harbor clause of the DMCA, unless a copyright holder is actively watching your live channel, how are they going to know you are playing music over said broadcast? Does twitch operate in a similar way to YouTube from the angle of "ad-rev", wherein you have to have a partner network behind you for you to archive streams as permanent videos that have music on them? They way I see it, because I am not a twitch partner, I should be able to archive broadcasts with any music in it, as any advertising revenue that may appear from pre-rolls does not go to me, or am I looking at this from the wrong point of view? The reality is is that the music in question isn't a primary focus of the stream, as I am commentating over the top (except in breaks) of games with friends and talking with them over Skype. Would it still cause problems if I archived the streams with the music in them? My account was temporarily suspended a year ago for having archived streams, and after turning archiving off I've never had a problem with it since, but I really would like to have my streams saved so people who miss them can re-watch them. Any and ALL clarification on the questions above will be gratefully received! :)
