The return of sub only giveaways?!?

I've asked this question once and would just like clarity I guess on how this is being allowed AGAIN on twitch. I watched a stream yesterday where someone gave away a game and made the giveaway subscriber only and when I called them out on it said that Twitch's ToS change allowed him to do so. I read this ToS and no where did I see in it that it allowed streamers to violate US Law about giveaways and how to run them. In the ToS it states that you have to follow local laws about giveaways, in the US its law that you cannot make a purchase necessary giveaway cause then it is no longer a giveaway it is a LOTTERY which makes it illegal, so by making a giveaway sub only it makes it purchase necessary and in turn illegal no? When I tried to explain this the streamer proceeded to tell me that Twitch's ToS change allowed him to run his giveaway like this and that he wasn't forcing people to subscribe lol even though his title said Archeage giveaway sub only lol. Then my question goes to in the ToS it says that twitch isn't promoting or sponsoring these giveaways, but if your streamers are making people subscribe and twitch is making money off these subscribers that come in on these "giveaways" wouldn't that make twitch just as guilty as the streamers doing the giveaway? I think Twitch needs to make it clear in their ToS on how giveaways are to be run, and put links to laws or just flat make sub only giveaways a big no no period in the ToS. Instead of making it very foggy and unclear and making streamers think that this behavior is legal and ok. I point this out not to be a dick and cause issue but to get clarity on a situation that if someone went to the right people could become an issue. I love twitch and watch tons of streamers and try to help by pointing out when they run giveaways like this that its wrong and am tired of being told I am complaining cause I want to win and Im not a sub. To be honest if I wanted the game I would buy it and if I wanted to win I would sub to me all this sub button has done is ruin twitch. Streamers start out and its all about the game and then they get popular and it becomes about the money and they have so many little screens on the game screen trying to get you to donate or subscribe that you can barely see the game play through all the garbage on the screen.
